Alternative Dispute Resolution Policy |
Registry Operator may offer the following alternative dispute resolution procedures:
(a) Registry Operator may offer a dispute resolution system for persons who believe that a domain name in the TLD infringes upon its trade names protected in the Netherlands, personal names, the name of a governmental body or the name of an association or foundation registered in the Netherlands. A complainant under this policy will need to show that the domain name was either registered in bad faith or is being used in bad faith in order to be successful in their dispute. All disputes under this policy will commence with mediation between the registrant and the complainant conducted by Stichting Internet Domeinregistratie Nederland (SIDN). If the complaint cannot be resolved between the registrant and the complainant in SIDN mediation, the dispute will be referred to the World Intellectual Property Organization for arbitration between the registrant and the complainant.
(b) Registry Operator may maintain a complaint system to hear allegations that a domain name in the TLD is unethical or irresponsible. Any person may contact the Registry Operator who will forward the complaint to a complaints board who will evaluate the complaint and recommend to Registry Operator what corrective action, if any, should be taken.
(c) Should any determination be made in connection with clauses (a) or (b) above that conflicts with a determination by a Uniform Domain Name Dispute Resolution Policy panel or a URS panel, then the determination of the applicable Uniform Domain Name Dispute Resolution Policy panel or a URS panel shall control.

Please provide the proposed language that describes the service. By providing this language, the RSP agrees to notify gTLD applicants that this language will be used in the registry agreement if the service is supported in the gTLD.

The parties agree that, except as set forth in this Amendment, the current terms and conditions of the Agreement will remain in full force and effect. All capitalized terms not defined will have the meaning given to them in the Agreement.
